The case of the suspended Deputy Commissioner of Police, Abba Kyari has taken a new turn as a Federal High Court in Abuja presided over by Justice Inyang Ekwo has refused to order his from the custody of the Nigeria Drug Law Enforcement Agency (NDLEA).
Abba Kyari and four others are alleged to be involved in illegal drug transaction running into several million of naira while on suspension by the Nigerian Authority as a result of his being declared wanted by the United States Federal Burean of investigation (FBI) of intelligence following his link with other members of Nigerian drug barons now in police net in America and the application of FBI to the Nigerian government for the extradition of the highly dreaded Nigeria supercop and Head of IRT Unit of the Nigeria Police.
Justice Ekwo rather ordered Mr Kyari to put the federal government on notice of the suit he instituted.
Mr Kyari in an ex-parte motion filed by his counsel Obianuju Ikena claimed that he is suffering from diabetes which needs urgent medical attention.
Justice Ekwo in his brief ruling ordered that the respondent be notified.
He also noted that the averment and allegations made against the federal government are weighty and the court must give the government an opportunity to be heard before taking any decision.
