The National Chairman of Action Alliance,AA,Chief Barr. Kenneth Udeze has applauded judiciary over his recent victory in the Court of Appeal.
Barr. Udeze commended the Presiding judge of the Appeal Court who made reference to what civil servants do and warned Independent National Electoral Commission,INEC to stop crying more than bereaved in terms interfering in political parties internal democracy affairs. He said, “It’s unfortunate that a native of Osun State who claims to be a native doctor decided to inject crisis into a party which he is not even a member of the National Working Committee.
“My victory has indicated that nothing bind together light and darkness. This is victory for democracy and judiciary. My family members can now be at rest as the head of the family is no longer busy pursuing case in the court. They targeted to stop us from participate actively in the last off-cycle gubernatorial elections in Imo,Bayelsa and Kogi States. But what is important is that the leadership of AA has been restored. We are now ready for Ondo and Edo States elections.
“I glorify the Almighty God who gave me this victory. We are getting stronger now. We are going to do in 2027 general elections. I thank members of AA who believe in my leadership. We are leaving no stone unturned in ensuring that our Party is repositioned”,he added.
It would be recalled that Abuja Division of the Court of Appeal on Friday resolved the protracted National Chairmanship tussle in the Action Alliance (AA) in favour of Kenneth Udeze.
In a unanimous judgment, a three-member panel of the appellate court affirmed Kenneth Udeze as the authentic National Chairman of Action Alliance (AA).
Justice H.A. Barka who delivered the lead judgment of the court dismissed the Appeal filed by one Adekunle Rufai Omoaje in Appeal number:CA/ABJ/CV/955/2022 challenging the judgment of the High Court of the Federal Capital Territory (FCT), in suit number:FCT/HC/CV/174/2022.
The judgment of the High Court which was delivered on March 28, 2022, by Justice Eleojo Enenche affirmed Udeze as the authentic National Chairman of Action Alliance (AA) and validated the 14th, March 2021 National Convention of the party.
In dismissing the appeal for lack of merit, the Court of Appeal further awarded the cost of N4 million against Adekunle Rufai Omoaje in favor of Udeze and the other three respondents.
Justice Barke held, “I am of the view that the appellant has not placed any reasonable material before this court to warrant this court to interfere with the judgment of the lower court
“This appeal lacks merit and is deservedly dismissed with a cost of N1m each in favour of the respondents, ” Justice Barka held.
In a swift reaction, Omoaje who was present at the court has vowed to challenge the judgment at the Supreme Court.
In a sister judgment, a three-member panel of the Court of Appeal led by Justice H A. Barka also affirmed Kenneth Udeze as the authentic National Chairman of Action Alliance (AA).
The second judgment was in respect of appeal number:CA/ABJ/CV/526/2022 Between one Uzewuru Nwachukwu Vs Kenneth Udeze and 2 ors.The parties in this Appeal avail themselves at the Court of Appeal mediation center and amicably settled all issues regarding the position of the National Chairmanship of Action Alliance (AA) in favor of Udeze and was adopted by all parties which the Appeal court had entered as a judgment in favour of Udeze as the authentic National Chairman of Action Alliance (AA).
With the two courts of Appeal judgments this January 26 affirming Udeze as the authentic National Chairman of Action Alliance (AA), is now finally put to rest the party’s prolonged legal tussle on the National Chairmanship.
