Barely Two weeks after the police granted Mazi Chinonso Uba Nonsonkwa bail,the court has squashed the application to remand Nonsonkwa in Prison throughout the trial brought by the police.
You may recall that after an FCT Abuja High Court ordered the release of Mazi Chinonso Uba Nonsonkwa on the 18th of August 2023, over unlawful detention but the Police delayed his release till the 29th August 2023.
The police had earlier refused to arraign Nonsonkwa after filing a two count charge of cyber crime against him on the 9th of August 2023 but refused to get a date for arraignment till Nonsonkwa’s legal team got the September 11th date for first hearing for bail application before the police bowed to the FCT Abuja High Court’s of August 18th which ordered the Inspector General of Police to release Nonsonkwa immediately which they never did till Nonsonkwa’s legal team filed a contempt of court charges against the police boss which forced them to grant Nonsonkwa bail on the 29th August 2023.
Meanwhile on the 11th of September 2023, the police opposed the bail application filed by Nonsonkwa’s legal team on the basis of Nonsonkwa’s alarm that his life is in danger after being granted bail,but the Presiding judge trashed such argument, saying that whoever feels his or her life is in danger has the fundamental right to raise alarm provided there is a cause for alarm.
The judge enquired to know from the police prosecutor if Nonsonkwa has breached the bail conditions ,the prosecutor said No. But just the allegation that Hope Uzodimma is planning to kidnap and assassinate him,upon which the court upheld as being the right of Nonsonkwa to raise alarm for his life because,life has no duplicate.
The Judge therefore granted Nonsonkwa bail and the Court adjourned till the 16th of October 2023 for trial to continue.
